Now for the rest of this year the EB2 queues for China and India are merged. Visa allocations will be solely based on Priority date. So for example if India has many priority dates that are before China's, India may end up getting more visa allocations. The same holds true if China has earlier priority dates than India does. Because if they enforce the country caps in H1b the whole H1 program will collapse. I know the difference between h1 and green cards but when you bring people into US on H1 without country caps they should not enforce country caps on H1 to green cards skilled category. The people who are oppose immigration are using this(the country cap or rather quota) as an excuse to make things worse for immigrantion. I had estimated that Eb2India pending applications (with PD earlier than or equal to Dec31, 2003) are probably about 4,900. This is almost 1.75 years worth of EB2India quota. If there is no spillover, then someone with Dec31, 2003 PD would have to wait at least till mid FY10 to get their GC. However, if there is spillover (especially from EB1 ROW considering that EB1India may not have much left).
