An attorney with the Public Defender's Office in Bushnell has been suspended by the Florida Bar because drug testing mandated after an earlier DUI arrest came back positive for cocaine use.
Hugh Henry Lee, 54, was suspended on May 26 for 30 days, the Florida Bar announced Thursday. Upon reinstatement, he will remain on probation for three years and will continue to be monitored.
According to a Florida Bar complaint, this is how Lee got into trouble:
He was an assistant public defender on June 5, 2009, when he was arrested for DUI in Pasco County. He refused to take a breath test and entered a no contest plea to the charge six months later, with the court giving him 12 months probation.
On May 17, 2010, Lee accepted an Eighteenth Judicial Circuit Grievance Committee recommendation that he enter into a three-year rehabilitation contract, receiving diversion treatment from an organization called Florida Lawyers Assistance Inc.
FLA is a non-profit corporation formed in 1986 in response to the Florida Supreme Court's mandate that a program be created to identify and offer assistance to Florida Bar members who suffer from substance abuse, mental health, or other disorders which negatively affect their lives and careers. FLA is independent of the Florida Bar, although it does receive funding from that organization.
As part of the treatment, Lee was tested for drug use and one of those tests came back positive for cocaine in October 2010, the Florida Bar complaint said. Lee denied using cocaine, alcohol or any other drug, but had no explanation for the positive results.
"Respondent stated that he could not argue with the test results, he did not want a second test run and he did not challenge any possible error," the Florida Bar complaint said.
Lee, who was part of a Fifth Circuit Court team that tried to give drug offenders treatment-based options to jail, failed another drug test in March 2011, the Florida Bar complaint said.
